We at NonStop™ are committed to protecting the privacy of our customers, and we treat any information you share with discretion, care and respect. This notice describes our privacy policy for information we collect from individuals both on-line (on our website) and off-line (such as by mail or telephone).

What Types of Personal Information We Collect On-Line and Off-Line
Personal Information is individually identifiable information about a customer that can be used to identify them. This can be things like their first and last name, home address, email address, telephone number, social security number or any other combination of information that could be used to identify an individual.
Personal information is collected from you about you and your child through our web site or on Scorecards that your child manually fills out. The NonStop™ program collects the following personal information about your child: full name; address; date of birth; height; weight; gender; race; email address; nutritional habits; physical activity habits; personal goals; TV time; video game time and computer time. You may also be asked if your child is a member of a particular managed care organization or health plan.
Cookies
We use "cookies" to track traffic patterns on our Web site, to determine the usefulness of goingnonstop.com information to our users and to see how effective our navigational structure is in helping users reach that information. A "cookie" is a small data file that the Web site writes to your computer hard drive when you visit it. A cookie file can contain information such as a user ID that the site uses to track the pages you have visited, but the only personal information a cookie can contain is information you supply yourself. A cookie cannot read data off your hard drive or read cookie files created by other Web sites. NonStop™ does not correlate this information with data about individual users, nor does it share this information or sell it to any third party. You will need to have cookies turned on to fully utilize the benefits of the goingnonstop.com web site.
How We Use Personal Information Collected On-line and Off-line
NonStop™ is a program designed to measure a child’s physical and nutritional behavior patterns during seven 6- week programs throughout the year. This behavior measurement allows us to target the child’s interests so that we may provide positive messaging and reinforcement to them based on their individual aspirations and personal goals. These messages may come from Corporate Sponsors, athletes, entertainers or the entity/company that is sponsoring your child’s program. In order for NonStop™ to provide the most appropriate messages to the participating child, it is necessary for us to actively collect the information outlined in the What Types of Personal Information We Collect section above.
The NonStop™ program gives children incentives to participate and complete each 6-week program by providing a reward for the successful completion of each 6-week program if they attain a total of 15,000 points or greater. A child earns points based on the how active they are, the nutritional choices they make and how much screen time they have each day. For the purposes of the NonStop™ Program, "screen time" shall mean watching television, playing video games or how long your child is on the computer. Computer time does not include time spent doing homework or any other required school activity.
All of the information collected at the time of registration, on the "Tell Us About Yourself" questionnaire and on the daily Activities scorecards is required in order to participate in the NonStop™ program with the exception of 3 questions on the "Tell Us About Yourself" questionnaire. Those questions that are not mandatory for participation are: "What is your favorite food?", "What is your favorite TV Show", and "Who do you want to be like?". These questions allow us to identify motivators for your child but are not required for participation in the NonStop™ program.
In addition to the information collected from you and your child during participation in the NonStop™ program, there will be times when we will poll you and/or your child for their general opinions on a variety of products and subjects. This will usually be one question with several pre-selected answers for you and/or your child to choose from. You and/or your child do not have to participate in these polls as they are strictly voluntary.
All of the information collected from your child through our web site or through scorecards that your child manually fills out is stored in a secured data base and used for reporting or marketing purposes as outlined below.

* Aggregate Reporting
Reports will be generated and provided to the various sponsors of the program. We will not release you or your child’s name, street address, phone number or e-mail address without your express permission to do so. Aggregate reporting (reports that do not directly or personally identify you or your child) will be provided to sponsors in an effort to identify trends relative to the information that we collect for the purpose of developing appropriate marketing strategies. There are no restrictions under this Privacy Policy to aggregate or de-personalize you or your child’s information and we may use the resulting non-personally identifiable information in any way.
* Personally Identifiable Reporting
Reports that personally identify you or your child will only be provided to:
   * the direct sponsor of your program;
   * school counselors or nurses (for school based programs);
   * contracted managed care organizations or health plans (HMO’s) where your child is a member for their health insurance coverage(s).
* Marketing and Promotional Materials
Many advertisements are managed and placed on our Web site by third parties. These companies are called "network advertisers." Network advertisers who place advertisements on our Web sites may also use cookies and Web beacons to collect non-personally identifiable information when you click on or move your cursor over one of their banner advertisements. You may not realize this information is being collected. In some cases, we may have access to information from Web beacons and cookies used by network advertisers on our sites and this information may permit us to identify other sites that you have visited that are also associated with the network advertiser. Finally, once you've clicked on an advertisement and have left our Web site, our Privacy Policy no longer applies and you must read the privacy policy of the advertiser to see how your personal information will be handled on their site.
* Disclosures Required By Law
NonStop™ will disclose personal information when it believes in good faith that such disclosures (a) are required by law, including, for example, to comply with a court order or subpoena, or (b) will help to: enforce our Terms of Use; enforce contest, sweepstakes, promotions, and/or game rules; protect your safety or security, including the safety and security of property that belongs to you; and/or, protect the safety and security of our Web site.
* Third Parties
NonStop™ hires and contracts with companies to help deliver products or services, like a shipping company that delivers a package or a company that helps fulfill prizes for the rewards part of the NonStop™ program. In those instances, there is a need to share your information with these companies. Except as separately permitted by other provisions of this Privacy Policy, these companies are allowed to gather, receive, and use your information only for the purposes described in this paragraph or as required by law.
Kids Under 13
The Children's Online Privacy Protection Act ("COPPA") requires that we inform parents and legal guardians about how we collect, use, and disclose personal information from children under 13 years of age; and that we obtain the consent of parents and guardians in order for children under 13 years of age to participate in the NonStop™ program. Registration and Kids Under 13
You, the legal parent or guardian of a child must register your child or children for the NonStop program. Children are not allowed to register themselves as the program requires the legal parent or guardian to create their own user id and password prior to setting up the same for their child or children. When you, the legal parent or guardian begin the registration process you will be asked to read this Privacy Notice and by clicking “I Agree” you are acknowledging that you have read the Privacy Notice and agree with all terms and conditions set forth in said document child’s User ID and password so that you may access their account at any time. If at any time your child changes their User ID or Password, you will also be notified by email of that change.
How Can Parents Access, Change or Delete Personally Identifiable Information About Their Kids?
At any time you, the parent, can revoke your permission for us to collect further personal information from your child and can request that any personal information we have already collected be deleted from our records. We use two methods to allow parents to access, change, or delete the personally identifiable information that we have collected from their children.
You, the parent, can access, change, or delete your child's personal information by logging on to your account and clicking the Child Termination Link in the left hand column and following the instructions from there.
You, the parent can also contact our customer service department to access, change, or delete the personal information that we have collected from your child by sending an e-mail to support@goingnonstop.com or by calling us at 1-866-234-4722. Please have your child’s name, User ID and Password along with your (the parent’s) User ID, Password and e-mail address so that we can better assist you with your inquiry or request.
Notification of Changes to the NonStop™ Privacy Policy
We may amend our Privacy Policy at any time. We will provide you, the parent notice by e-mail of any material changes in the way we intend to collect, use, and/or share your child’s personal information. Please note that, at all times, you the parent should update your personal information to provide us current e-mail addresses. We will apply material changes in our Privacy Policy only in conformance with applicable law, including any applicable provisions of COPPA that require parental consent.
Permission Term
Your acceptance of the terms of this Privacy Notice and your child’s participation in the NonStop program is in effect for 1 calendar year. If during that calendar year your child signs up through a different Plan Sponsor then you, the parent will have to accept the terms of the Privacy Notice for your child to participate. You may at any time terminate your child’s participation in the program by following the instructions listed above under How Can Parents Access, Change or Delete Personally Identifiable Information About Their Kids?
